Heard Ms. Mishra, learned Advocate for Applicant and Ms. Hivrale, learned APP for the State.

The Applicant in the present case is behind bars for more than 3 years. He is indicted under Section 302 read with 34 of Indian Penal Code, 1860. The case of the prosecution is that he is the owner of the Company and along with his two associates responsible for inflicting injuries on the victim who was found dead. The victim incidentally was an employee of the Applicant's Company called Bigo Packers and Movers Pvt. Ltd. Company and there was dispute regarding some amount between them as reflected in the prosecution's case.

Ms. Mishra, learned Advocate appearing for the Applicant would submit that till today the case has not been committed and there is undue delay in commencement of trial. She would submit that in that view of the matter and considering the fact that the Applicant is having no antecedents, he may be released on bail with any stringent condition whatsoever that may be deemed fit by the Court. 4.

Learned APP to place before me the steps taken by the prosecution for the trial. Appropriate report shall be called for within a period of two (2) weeks from today. Bail Application shall be considered thereafter after examining all parameters including the post-mortem report and other incidental and ancillary issues including hearing the learned APP.
