Heard Mr. Rathod, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent.

The order dated 28.04.2025 stands complied with. Affidavit of Assistant Commissioner of Police, East Division, Bhiwandi in the present Application stands filed. Copy of the same is handed over to Mr. Rathod.

Applicant is one of three Accused for indictment in offences punishable under Maharashtra Control of Organised Crimes Act, 1999 (for short 'MCOC Act') and is incarcerated for the past 2 years 3 months as seen by the Court.

Mr. Rathod would submit that charge has not been framed and in that view of the matter trial has not commenced and completion

906.BA.4071.2024.doc of trial in the near foreseeable future is a distinct impossibility. Prima facie, what is stated by Mr. Rathod appears to be true and hence the Bail Application deserves consideration.

Learned APP shall take appropriate instructions on the precise status of trial and accordingly apprise the Court on the next adjourned date when present Application shall be heard and decided. 6.
