Heard Mr. Vishal Rankhambe, learned Advocate for the Applicant, Ms. Manisha Tidke, learned A.P.P. for the State/Respondent and Mr. Vivek Salunke, learned Advocate for Respondent No. 2.

By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 194 of 2022 registered with Karjat Police Station, District-Raigad for the offences punishable under Sections 302 & 201 of the Indian Penal Code, 1860.

Mr. Vishal Rankhambe, learned Advocate for the Applicant submits that the abovesaid crime is registered as Sessions Case No. 167 of 2022 and is pending on the file of Additional Sessions Gitalaxmi

After having heard the matter for some time and upon this Court having expressed its view of not being inclined to entertain the present Application, Mr. Vishal Rankhambe, learned Advocate for the Applicant sought a pass over.

After sometime at the request of Mr. Vishal Rankhambe, learned Advocate, the matter was taken up. Mr. Vishal Rankhambe, learned Advocate on instructions from the Applicant craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court in the event of change in circumstances.

Ms. Manisha Tidke, learned A.P.P. for the State/Respondent does not object to the request made by Mr. Vishal Rankhambe, learned Advocate.

Applicant is always at liberty to file a fresh Bail Application before the learned Trial Court in the event of chance in circumstances. If such Application is filed by the Applicant before the learned Trial Court on the ground of change in circumstances, the same be considered on its own merits and in accordance with law.
