Heard learned counsel for the parties for sometime. The learned counsel appearing for Narcotics Control Bureau (NCB) has tendered affidavit in reply. The same is taken on record.

In the affidavit in reply, reference is made to criminal antecedents of the applicant. The document on record show that although an order of extornment was passed against the applicant, it was subsequently set aside. Two of the four criminal antecedents have not resulted in conviction of the applicant and remaining two criminal antecedents pertain to offences under Sections 324, 332, 353 and 504 of the IPC. But, in the body of the reply affidavit, a reference is made to a case under the Maharashtra Control of Organized Crime Act, 1999, pending against the applicant. Shrikant Malani
