DR. NEELA GOKHALE, J.
DATED:
16TH SEPTEMBER 2025 PC:- 1.
After hearing learned counsel for the Applicant for some time, when this Court was not inclined to allow the present Bail Application, Mr.Cusher, learned Advocate for the Applicant seeks leave to withdraw the present Bail Application.
2.
Ms.Bajoria, learned APP states that charges are framed and trial has commenced as also witness summons
have also been issued. The prosecution intends to examine in all 20 witnesses as per the list of witnesses. 3.
Mr.Cusher has a grievance that in last 14 days no hearing has taken place and the trial is being delayed. In these circumstances, the trial Court is directed the expedite the trial and conclude the same within a period of 8 months from today.
4.
Mr. Cusher also brings to my notice that the Applicant has a daughter aged 15 years as on date. His wife is pre-deceased and hence his daughter is currently residing in a shelter home at Mankhurd. Applicant has not met her for a long time. Hence, the Child Welfare Committee (CWC), Mankhurd having jurisdiction over the matter, is requested to allow the daughter to be brought to the Mumbai Central Prison (Arthur Road Jail), to visit the Applicant once in a month, if an Application is made to the CWC by the Applicant seeking such permission. The CWC will however ascertain as
to whether the daughter is inclined to visit the Applicant in jail.
5.
Leave is granted to withdraw the present Bail Application with liberty as prayed.
6.
Bail Application is disposed of as withdrawn. (DR. NEELA GOKHALE, J)
