Heard Mr. Pawar, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent - State. 3.
Mr. Pawar, learned Advocate for Applicant would submit that Applicant is the Director of the Company. He has been indicted for an offences punishable under the provisions of Indian Penal Code, 1860 and the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999.

He would submit that during the pendency of the present Bail Application, the Chairman of the said Company has been released on bail by the Trial Court due to non-compliance of the provisions of Section 50 of the Code of Criminal Procedure, 1973 (for short
76.BA.4116.24.doc "Cr.P.C."). He would submit that in the case of the Applicant before the Court there is absolute non-compliance of the provisions of Section 50 of the Cr.P.C. in as much as the Applicant has not informed the ground of his arrest.

Ms. Ganapathy, learned APP is directed to consider the submissions made by Mr. Pawar and take take appropriate instructions from the concerned Investigating Officer and apprise the Court about the role of the present Applicant on the next adjourned date. 6.
If the Court finds that there is any dereliction and noncompliance of Section 50 of the Cr.P.C. then the present Application will have to be allowed.

That apart, learned Advocate for Applicant would submit that a substantial property of the Company has been seized by the prosecution to the tune of more than 700 crores and therefore case of the prosecution case in so far as the amounts are concerned, stands fully secured.

List the Bail Application on Board on 08th April, 2025. To be placed on the 'Supplementary Board'.
