Heard Ms. Patil, learned Advocate for Applicant and Mr. Haldankar, learned APP for Respondent - the State of Maharashtra. 2.

This is an Application under Section 439 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking Bail in connection with C.R. No.472 of 2022 registered with Kashimira Police Station for offences punishable under Sections 363, 376, 347 of Indian Penal Code, 1860 and Section 4 of the the Protection of Children from Sexual Offences Act, 2012 (for short 'POCSO'). 3.

Pursuant to the order dated 11.10.2024, Investigating Officer has placed on record the printed proforma wherein one of the option stated therein which acknowledges receipt of Application and that Respondent No.2 will appoint a private Advocate to represent her in

Today when the matter is called out, none is present on behalf of Respondent No.2. I have impressed upon the representative who is present on behalf of the Investigating Officer to depute a responsible lady police officer to call upon Respondent No.2 and explain to her the position in law pursuant to which she shall take appropriate instructions from Respondent No.2 and same shall be conveyed to this Court through the learned APP. If Respondent No.2 desires to appoint Advocate, she should be informed to ensure that her Advocate remains present on the next date i.e. 31.01.2025. The aforesaid exercise shall be carried out within a period of two days from today.
