This is an application for bail.

The applicant came to be arrested in Crime No. 306 of 2020, registered at Bhosari Police Station, Dist-PimpriChinchwad for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

The deceased was the father of the present applicant. According to the prosecution, there was a property dispute between the applicant and the deceased. It is alleged that on the date of the incident which took place on 16.06.2020, on account of the said property dispute, the present applicant assaulted the deceased by certain hard and blunt object and committed his murder. 4.

The case is based on circumstantial evidence. The applicant is in jail for about five years. This Court, by order dated 06.11.2023 in Bail Application No. 2461 of 2023, directed the trial Court to conclude the trial expeditiously. Inspite of the said order, the trial is still at the stage of framing of charge.

Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, the following order is passed:

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in Crime No. 306 of 2020, registered at Bhosari Police Station, Dist-Pimpri Chinchwad for the offences punishable under Sections 302 and 201 of the Indian Penal Code, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
