This is an application for regular bail.

The applicant came to be arrested in Crime No.88 of 2023 registered at Gokul Shirgaon Police Station, Kolhapur for the offences punishable under Sections 302, 201 and 120-B read with 34 of the Indian Penal Code.

It is the case of the prosecution that the wife of the deceased was having extra marital affair with the present applicant. It is alleged that the deceased was asking his wife to break the said relationship. It is alleged that thus on the date of incident, which took place on 21.04.2023, the present applicant along with other co-accused strangulated the deceased and committed his murder. It is alleged that to cause disappearance of evidence, the dead body of the deceased was thrown in the well. Dinesh S. Sherla 1/2

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

The case is based on circumstantial evidence. The applicant is in jail for for more than 1 and 1⁄2 years. The trial has not commenced. It is not the case of the prosecution that the applicant, if released on bail, may abscond. In that view of the matter, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R. No.88 of 2023 registered at Gokul Shirgaon Police Station, Kolhapur for the offences punishable under Sections 302, 201 & 120-B read with 34 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
