CORAM : MILIND N. JADHAV, J.
DATE : MAY 02, 2025 P. C.
:
1.
Heard Mr. Prasannan, learned Advocate for Applicant and Mr. Pethe, learned APP for State.
2.
Learned Advocate for Applicant informs the Court that Interim Application bearing No.1683 of 2025 has been filed, inter alia, seeking extension of time with respect to medical bail which was extended to the Applicant by order dated 27.01.2025.
3.
Mr.Prasannan, learned Advocate for Applicant draws my attention to paragraph No.5 of the said order and would submit that in compliance of directions contained therein status Affidavit alongwith the details of treatment and medication undertaken by Applicant has been filed. Said Affidavit in dated 26.04.2025. I have perused the same with the able assistance of learned Advocate for Applicant as also learned APP for State.
4.
Prima facie it is seen that medical condition of Applicant is precarious. All details of treatment having been undertaken by him pursuant to his release on bail until the filing of the Affidavit have been duly explained alongwith all supporting documents which prima facie cannot be disregarded or disbelieved.
5.
Mr. Prasannan would persuade the Court to consider case of the Applicant for grant of regular bail in view of the precarious medical condition of Applicant.
6.
Mr. Pethe, learned APP is directed to take immediate instructions on the status Affidavit dated 26.04.2025 to consider the Application of Applicant for grant of regular bail. 7.
That apart there is request made by Mr. Prasannan that in view of the critical medical condition of Applicant he was unable to meet with the condition for filing the surety as directed in clause (i) of
the order dated 27.01.2025. Hence he would request for extension. In view of the Applicant's ailment, though there is a delay involved, I am foregoing the delay and extending the time given to the Applicant for filing the surety. Time to file the surety stands extended by four weeks from today.
8.
Stand over to 6th May, 2025 (F.O.B.) for hearing of Bail Application.
