Heard Ms. Ausarkar, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent No.1 - State. 3.

This is an Application under Section 439 of the Code of Criminal Procedure, 1973 seeking Regular Bail in connection with C.R.No.62 of 2022 registered with Dindoshi Police Station, Mumbai. 4.

Applicant is indicted for the offences punishable under Sections 376(2)(f), 376(3)(k) and 506 of the Indian Penal Code, 1860 and Section 6 of the Protection of Children from Sexual Offences Act, 2012 in C.R. No.622 of 2022.

In the present Application, notice has already been issued on 22.10.2024.

Since notice has been served which is evident from the remark of the Registry and considering long incarceration of the Applicant for the past 2 and 1⁄2 years, I am inclined to appoint Ms. Kanchan Pawar (Mobile No.9819982466), through the High Court Legal Aid Services Committee of this Court to represent and espouse the cause of Respondent No.2 forthwith.

The High Court Legal Aid Services Committee of this Court is directed to give appointment letter and papers of the matter to the appointed Advocate forthwith in accordance with law to represent and espouse the cause of Respondent No.2 through the Legal Aid. 8.

As also, Ms. Ausarkar, learned Advocate for Applicant is directed to serve a copy of the Bail Application on the Advocate appointed.

Appointed Advocate is directed to take instructions from Respondent No.2 and get prepared in the matter. 10.

Investigating Officer is directed to give the number and mobile number of the appointed Advocate to Respondent No.2 / her legal guardian.

Let the above exercise be carried out within a period of one week from today.

Stand over to 13th February 2025. To be placed under the caption "First on Board".
