This is an Application under Section 439 of the Code of Criminal Procedure, 1973 seeking Regular Bail in connection with C.R.No.38 of 2024 registered with Shahu Nagar Police Station. Applicant before me is 21 years old engineering student who is incarcerated for the one year in the offences punishable under Section 307 of the Indian Penal Code, 1860.

Weapon used in the present crime is knife and there is wound / stab injury inflicted by the Applicant. Prosecution case is that Applicant injured the victim. However, according to the Applicant both

103.BA.4221.24.doc Applicant and victim are friends and there was a verbal altercation between them when the Applicant informed the victim not to visit Siddhivinayak Temple it was not taken kindly by the victim and according to the Applicant the victim initially assaulted the Applicant because of the verbal altercation and the Applicant retaliated. 5.

Mr. Shaikh, learned Advocate for Applicant would submit that in the altercation which ensued the Applicant inflicted the stab wound with the knife.

The credentials and details of the education of the Applicant shall be placed before the Court by the learned Advocate for Applicant on the next adjourned date to enable this Court to hear the present Application.

Learned APP is directed to take appropriate instructions from the concerned Investigating Officer in view of the fact that present case.
