2) By this applications under Section 439 of the Code of Criminal Procedure the applicants are seeking bail in Crime No.49 of 2022 registered with Umdi Police Station, Sangli for the offences punishable under Sections 302,307, 341, 143, 147, 148, 149 and 506 of the Indian Penal Code, 1860, Section 4/25 of Arms Act, 1959 and Section 135 of the Maharashtra Police Act, 1951.
3) This Court granted bail to co-accused Manohar Dhondiba Bhise and Sanjay @ Malikarjun Shamrao Shinde. Whereas, the Hon'ble Supreme Court of India granted bail to co-accused Tejasvikumar @ Yalappa Gundappa Salunkhe @ Bhat.
4) Considering the said fact that the Hon'ble Supreme Court of India has granted bail to the co-accused on the ground of long period of incarceration, I am of the opinion that the same principle will apply to the present case. Accordingly, the parity will apply. In the circumstances, I pass the following order.
ORDER
i The Bail Applications are allowed;
ii It is directed that the Applicants shall be released on bail in Crime No.49 of 2022 registered with Umdi Police Station, Sangli for the offences punishable under Sections 302, 307, 341, 143, 147, 148, 149 and 506 of the Indian Penal Code, 1860, Section 4/25 of Arms Act, 1959 and Section 135 of the Maharashtra Police Act, 1951, on furnishing P.R. Bond of 2/3
Rs.25,000/- (Rupees Twenty Five Thousand) each with one solvent surety in the like amount;
iii The applicants shall attend the said Police Station on 1st day of every month between 12.00 noon to 2.00 p.m., till the conclusion of the trial except on the date of trial; iv.
The Applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence; v.
Liberty is granted to the State to apply cancellation of bail if the applicants commits similar offence.; vi.
The Applicants shall attend the trial before the Trial Court regularly on every date unless exempted by the Trial Court for any reason.
