By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant, who is the Accused, is before this Court seeking regular bail in connection with Crime No. 134 of 2013 registered with Baramati Taluka Police Station, Pune Rural for the offence punishable under Sections 302, 201, 404 and 120-B of the Indian Penal Code, 1860 ("IPC" for short).

Mr. Bhushan Raut, learned Advocate for the Applicant

submits that the present Bail Application is being pressed on the ground of right to speedy trial. He submits that the Applicant is in jail for the last 8 years and 4 months. He therefore requests for consideration of the case of Applicant on the ground of long incarceration.

Mr. Bhushan Raut submits that though initially the Applicant was released on bail, however, the bail was cancelled by this Court by order dated 23rd February 2017, passed in Criminal Application No. 680 of 2013 filed by the State/Respondent as well as in Criminal Application No. 9 of 2014 filed by the wife of deceased. 5.

Mr. Shrirang Chaudhari, learned A.P.P. for the State/Respondent submits that the bail granted to the Applicant on 11th September 2013, having been cancelled at the instance of State/Respondent and also wife of the deceased, it would be appropriate to afford hearing to the said wife of deceased, in the present proceedings.

In view of the above and considering the order dated 23rd February 2017, passed in Criminal Application Nos. 680 of 2013 and 9 of 2014, it would be appropriate in the interest of justice that the wife of deceased be heard in the present matter. 7.

In view of the above, issue notice to the wife of deceased viz. Ms. Hemlata Dadasaheb Chaudhar, resident of Wanjarwadi, Gavchi Chaudhar Wasti, Taluka-Baramati, District-Pune. 8.

Considering urgency as submitted by Mr. Bhushan Raut, learned Advocate, the notice be served through the Investigating

Officer of Baramati Taluka Police Station, Pune Rural. Notice to indicate that the matter would be heard finally on the returnable date and Ms. Hemlata Dadasaheb Chaudhar should be ready to putforth her case in the present matter.
