This is an application for regular bail.

The applicant came to be arrested in Crime No.285 of 2024 registered at Umbraj Police Station, Karad, District : Satara, for the offences punishable under Sections 399, 286 of the Indian penal Code (for short 'IPC') and Section 5(a) of the Explosives Act, 1908 and Section 9(b) of the Explosives Act, 1984.

In the intervening night of 16.05.2024 and
17.05.2024, the present applicant and other co-accused were apprehended. It is alleged that they were preparing to commit dacoity.

The learned counsel for the applicant submits that the applicant is a student. It is submitted that the applicant is in jail for about nine months and there are no other criminal antecedents against the present applicant.

On the other hand, the learned A.P.P. for the Respondent-State submits that the applicant is involved in serious crime. It is submitted that explosive material was found in possession of the present applicant and other co-accused. It is submitted that considering the nature of offence, the applicant may not be released on bail. 6.
The learned counsel for the applicant has placed on record the documents to show that the applicant was taking education. There are no other criminal antecedents against the present applicant. The applicant is in jail for about nine months. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No.285 of 2024 registered at Umbraj Police Station, Karad, District : Satara, for the offences punishable under Sections 399, 286 of the Indian penal Code (for short 'IPC') and Section 5(a) of the Explosives Act, 1908 and Section 9(b) of the Explosives Act, 1984 on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall attend the concerned Police Station once in a month i.e. on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) The applicant shall not commit any other crime; (v) Application stands disposed of accordingly.
