Heard Mr. Sutaria, learned Advocate for Applicant; Mr. Karmakar, learned APP for Respondent - State of Maharashtra and Mr. Tripathi, learned Advocate for Respondent No.2. 2.

This is an Application under Section 439 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking Bail in connection with C.R. No.533 of 2024 registered with Shrinagar Police Station for offences punishable under Sections 376 and 420 of the Indian Penal Code, 1860 (for short 'IPC') and Section 66C and Section 66D of the Information Technology .

Mr. Tripathi, learned Advocate appears for the prosecutrix.

4.BA.4366.2024.doc He would like to file Vakalatnama and represent and espouse the cause of victim. He is permitted to do so by the Court despite the initial opposition of Mr. Sutaria which is not appreciated by this Court. 4.

Mr. Tripathi undertakes to file his vakalatnama within a period of one week and whatever intervention application he desires to file and serve in advance on Advocate for Applicant. 5.

Considering the request made by Mr. Sutaria, learned Advocate for Applicant that Applicant is incarcerated from 09.08.2024 but the fact that date of tenure of incident is from the years 2021 to 2024, I am inclined to hear this Application on the next adjourned date which shall be noted by learned Advocate.
