This is an application for regular bail.

The applicant came to be arrested in Crime No.217 of 2024 registered at Dindori Police Station, Nashik Rural for the offences punishable under Sections 306, 498-A, 323, 504 & 506 of the Indian Penal Code, 1860 (IPC).

The deceased was the wife of the present applicant. According to the prosecution, the present applicant and the other co-accused were harassing the deceased on account of demand of dowry and the other issues. It is alleged that fed up with the said harassment on the date of incident which took place on 26.4.2024, the deceased along with her two sons aged about 9 years and 6 years had jumped into the pond and committed suicide.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant has drawn my attention to the statement of the Dnyandev Namdev Jadhav, who was the President of the Tantamukti Samiti and also the statement of the Sudhakar Sampatrao Ghadwaje. It appears from their statements that the co-accused in the present crime i.e., mother and brother of the present applicant were harassing to the deceased so also to the present applicant. A meeting was called and in the said meeting the present applicant had expressed his desire to stay separately from his mother and brother as they were continuously harassing the deceased. Considering the said statements, I am inclined to release the applicant on bail.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in connection with Crime No.217 of 2024 registered at Dindori Police Station, Nashik Rural for the offences punishable under Sections 306, 498-A, 323, 504 & 506 of the IPC on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount; (iii) The application is disposed of accordingly.
