This is an application for regular bail.

The applicant came to be arrested in Crime No.161 of 2024 registered at Wavi Police Station, Dist- Nashik, for the offence punishable under Sections 302, 326, 324, 323, 143, 147, 148, 149, 504 and 427 of the Indian Penal Code (IPC). 3.
According to the prosecution, on the date of incident which took place on 11.04.2024, the present applicant and other co-accused assaulted the deceased and his family members by stick etc. on account of previous disputes. It is alleged that in the incident the deceased had sustained serious Zeenat Pathan

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The applicant was not armed with any weapon. The alleged assault on the deceased is not attributed to the present applicant. The applicant is in jail for ten months. Considering the overall facts and circumstances, I am inclined to release the applicant on bail. In the result the following order is passed :
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No.161 of 2024 registered at Wavi Police Station, Dist- Nashik, for the offence punishable under Sections 302, 326, 324, 323, 143, 147, 148, 149, 504 and 427 of the Indian Penal Code (IPC) on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) Application stands disposed of accordingly.
