This is an application for regular bail.

The applicant came to be arrested in Crime No. 514 of 2016, registered at Shirur Police Station, District : Pune for the offences punishable under Sections 302, 109, 120-B r/w Section 34 of the Indian Penal Code.

According to the prosecution, on the date of incident, which took place on 28th August 2016, on account of previous dispute the present applicant and the other co-accused

assaulted the deceased by sharp weapons and committed his murder.

The learned counsel for the applicant submits that the co-accused Vishal Kale, who according to the eye-witness has assaulted the deceased by Koyta, has been released on bail. It is submitted that the applicant is in jail for six years and the trial is still at the stage of framing of charge. 5.

The learned A.P.P. for the Respondent-State on instructions, has not disputed the above facts. 6.

In that view of the matter, I am inclined to release the applicant on bail.

ORDER

(i) Bail Application is allowed;

(ii) The applicant shall be released on bail, on executing PR Bond in the sum of Rs. 50,000/- with one or two local solvent sureties in the like amount; (iii) The applicant shall not enter into the jurisdiction of Shirur Police Station, Pune, till the conclusion of the trial;

(iv) The applicant shall attend the concerned Police Station within whose jurisdiction he is going to reside after his release, on the first Saturday of every month

between 11:00 a.m to 2:00 p.m., till the conclusion of the trial;

(v) The applicant shall inform his residential address and mobile number to Shirur Police Station;

(vi) The application is disposed of in the aforesaid terms.
