This is an application for regular bail.

The applicant came to be arrested in Crime No. 95 of 2024 registered at Miraj City Police Station, Dist. Sangli for the offences punishable under Sections 307, 326, 452, 324, 323, 504 and 506 read with 34 of the Indian Penal Code.

It is the case of the prosecution that on the date of incident, which took place on 15.3.2024, the present applicant and other co-accused assaulted the injured by axe and iron rod and attempted to commit his murder on account of previous dispute. 4.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

Learned counsel for the applicant submits that the applicant is in jail for approximately 1 year and the trial has not Dinesh S. Sherla 1/2

31-ba-4443-24.doc commenced. It is submitted that there is a cross FIR and therefore there are two versions of the very same incident. 6.

On the other hand, learned APP for the respondent/State submits that the applicant is involved in one more crime under the Arms Act. It is submitted that considering the nature of offence, the applicant may not be released on bail.

The applicant is in jail for approximately 1 year and the trial has not commenced. Considering the said fact and as there is a cross FIR, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R. No. 95 of 2024 registered at Miraj City Police Station, Dist. Sangli for the offences punishable under Sections 307, 326, 452, 324, 323, 504 and 506 read with 34 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C] The applicant shall attend the concerned police station once in a month ,i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial.
