This is an application for regular bail.

The applicant came to be arrested in Crime No.189 of 2024 registered at Kurundwad Police Station, for the offences punishable under Sections 302, 307 read with Section 34 of the Indian penal Code.

The present applicant is Accused No.2 in the aforesaid crime. The deceased was a grandfather of the Accused No.1. It is alleged that as the deceased was not treating the mother of the Accused No.1 well and thus on the
date of incident which took place on 23.04.2024, the Accused No.1 and the present applicant assaulted him by some sharp weapons and committed his murder.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant submits that the case is based on circumstantial evidence. It is submitted that the applicant has nothing to do with the alleged crime and the motive for the alleged crime is attributed to the Accused No.1. It is further submitted that there are no other criminal antecedents against the present applicant.

On the other hand, the learned A.P.P. for the Respondent-State submits that there is enough incriminating material to connect the applicant with the alleged crime. It is submitted that considering the nature of offence, the applicant may not be released on bail.

The case is based on circumstantial evidence. The motive for alleged crime is not attributed to the present applicant. There are no criminal antecedents against the
applicant. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No.189 of 2024 registered at Kurundwad Police Station, for the offences punishable under Sections 302, 307 read with Section 34 of the Indian penal Code on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount; (iii) The applicant shall attend the concerned Police Station once in a month i.e. on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) Application stands disposed of accordingly.
