By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 591 of 2023 registered with Chandan Nagar Police Station, Pune City for the offences punishable under Sections 307, 326, 324, 143, 144, 147, 148 and 149 of the Indian Penal Code Act, 1860 ("IPC" for short), Section 4(25) of the Indian Arms Act, 1959, Sections 37(1)(c) and 135 of the Maharashtra Police Act, 1951, Sections 3 and 7 of the Criminal Law Amendment Act, 2013 and Sections 3(1)(ii), 3(2) and 3(4) of the Maharashtra Control of Gitalaxmi

12-BA-4493-2024.doc Organized Crime Act, 1999 ("MCOC Act" for short). 3.

After having heard the matter for substantial time and upon this Court having expressed its view of not being inclined to entertain the present Bail Application, Mr. Niranjan Bhavake, learned Advocate sought a pass over.

After some time at Mr. Niranjan Bhavake, learned Advocate's request, the matter was taken up. Mr. Niranjan Bhavake, learned Advocate on instructions from the Applicant craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the learned Trial Court in the event of change in circumstances.

Mr. Pandurang Gaikwad, learned A.P.P. for the State/Respondent does not object to the request made by learned Advocate for the Applicant.

In view of the statement made by Mr. Niranjan Bhavake, learned Advocate, the present Bail Application is allowed to be withdrawn with liberty as prayed. In the event any fresh Bail Application is filed by the Applicant before the learned Trial Court upon change in circumstances, the same shall be considered on its own merits and in accordance with law.
