Heard Mr. Popat, learned Advocate for Applicant; Mr. Babar, learned Advocate for Intervenor and Mr. Karmakar, learned APP for Respondent - State.

Applicant is incarcerated in prison in an offence under the Indian Penal Code, 1860 and Maharashtra Protection of Interest of Depositors Act, 1999 for the past 1 and 1⁄2 years. In the present case, investigation is complete. The amount involved according to the First

Informant is to the tune of Rs.1.5 crores specific to the First Informant - Complainant against the Applicant before me. 3.

Learned Advocate for Applicant would submit that the prosecution has attached a property worth more than Rs.3 crores belonging to the Applicant as security. He would submit that Applicant has fully cooperated with the investigation and even according to the prosecution case the role attributed to the Applicant is that of he being present in the meeting alongwith other co-accused persons during the time when the investment proposal was heard by the First Informant upon which he took the decision to invest money which is the subject matter of the complaint.

Mr. Babar, learned Advocate for Intervenor enters appearance on behalf of the First Informant - Intervenor. He would submit that Intervention Application is filed by the First Informant to oppose the Bail Application. He would persuade the Court to consider Intervention Application at the time of hearing of the Bail Application. 5.

Mr. Karmakar, learned APP is directed to take appropriate instructions from the concerned Investigating Officer on the precise role of the Applicant in the crime and accordingly apprise the Court on the next adjourned date on the veracity of the aforementioned submissions to enable the Court to consider the Bail Application.

Considering the incarceration of the Applicant, present Application shall be heard and decided by the Court on the next adjourned date which shall be noted by the parties. 7.

List the Bail Application on Board on 24th April, 2025 at 02:30 p.m.
