Learned counsel for the applicant, on instructions, seeks leave to withdraw the application with liberty to file fresh application, if there is no progress in the trial, after one year.

Considering the submissions of learned counsel for the applicant, the application is allowed to be withdrawn with aforesaid liberty and disposed of.

Learned counsel for the applicant submits that direction be given to the Trial Court to frame the charge as the applicant is behind bar for around 4 1⁄2 years.

Considering the submissions of learned counsel for the applicant, the Trial Court is requested to frame charge against the applicant and co-accused as early as possible. The applicant and coaccused shall co-operate with the Trial Court for framing the charge without seeking any adjournment.
