Heard Mr. Bagade, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent - State. 2.

Applicant is incarcerated since 30.01.2020. Prima facie it is seen that crime is registered in the year 2018, when at the time of its registration originally there are 4 Accused persons. Applicant is arrested 2 years later.

Mr. Bagade, learned Advocate for the Applicant would persuade the Court to consider the Application for bail of the Applicant on two grounds namely merits of the case as also long incarceration. He would submit that role of the present Applicant is much lesser than the role of the co-accused who has been enlarged on bail by this Court, by order 22.07.2024 appended at page No.598 of the Application.

He would submit that qua the role of the co-accused who has been enlarged on bail, present Applicant has been alleged to have provided tips. He would fairly inform the Court that from the charge of the prosecution it is not established whether the alleged tips pertain to the crime in question or otherwise. That apart, he would submit that long incarceration of the Applicant and trial not having commenced. Advocate for the Applicant prima facie appears to be right. 5.

Prosecution shall take appropriate instructions from the concerned Investigating Officer and apprise the Court on the next adjourned date.
