Heard Mr. Shaikh, learned Advocate for Applicant and Mr. Sonavane, learned APP for Respondent - State of Maharashtra. 2.

This is an Application under Section 439 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking Bail in connection with C.R. No.637 of 2022 registered with Kalyan Taluka Police Station for offences punishable under Sections 376(3), 328, 34 of the Indian Penal Code, 1860 and Sections 4 and 17 of the Protection of Children from Sexual Offences Act, 2012.

Mr. Sonavane has placed before the Court consent of Respondent No.2 received through Investigating Officer. Respondent No.2 has requested appointment of Advocate through legal aid. 4.

I have persuaded Ms. Samiksha Pawar (Mobile

904.BA.4517.2024.doc Nos.9702285669 / 8779973450), learned Advocate practising at this bar to represent and espouse the cause of Respondent No.2. Ms. Pawar has graciously accepted the request made by Court. 5.

The High Court Legal Services Committee of this Court is directed to give appointment letter and papers of the matter to Advocate Ms. Samiksha Pawar forthwith in accordance with law to represent and espouse the cause of Respondent No.2 through the legal aid.

It shall be open to Mr. Shaikh, learned Advocate to hand over to her copy of brief to Ms. Pawar, learned Advocate appointed to represent and espouse the cause of Respondent No.2 - Complainant. Ms. Pawar is directed to take instructions from Respondent No.2 - Complainant and appropriately plead the case before the Court. 7.

Copy of this order shall be conveyed to Respondent No.2 - Complainant by Investigating Officer and learned APP shall ensure the same.
