By the present Application filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS"), the Applicant is seeking Regular bail in Crime No. 144 of 2023 registered at Samarth Police Station, Pune for the offences punishable under Section 7, 8 of the POCSO Act. Said crime is registered as Special Case No. 831 of 2023 and is pending on the file of the Additional Sessions Judge, Pune.

Bail Application filed by the Applicant was dismissed on 1st July, 2024.

After having heard the matter for some time on 3rd July, 2025, upon this Court having expressed its view of not being inclined to entertain this Application, Ms. Kaushalya Patil, sought for an adjournment to take instructions from the Applicant. 5.

Today, Ms. Kaushalya Patil, on the instructions from the Applicant seeks leave to withdraw the present Bail Application with liberty to file a fresh bail application before the learned Trial Court in the event of change in circumstances. Liberty as prayed for is granted. If such application is filed, the same shall be considered on its own merits and in accordance with the law. 6.

Criminal Bail Application No. 4524 of 2024 is dismissed as withdrawn with the above liberty.
