This is an application for regular bail.

The applicant came to be arrested in Crime No.131 of 2024 registered at Barshi City Police Station, Dist. Solapur for the offences punishable under Sections 457, 380 read with 34 of the Indian Penal Code.

According to the prosecution on the date of incident, which took place on 06.02.2024, the co-accused in the present crime had broke open the door of the jewellery shop of the complainant and committed theft of gold and silver ornaments worth Rs.1,13,13,320/-.

The bail is sought on the ground of parity. In support of said ground, learned counsel for the applicant has placed on record the copies of orders passed by the Sessions Court in Criminal Bail Application No. 428 of 2024 dated 5.8.2024, Criminal Bail Application No. 380 of 2024 dated 30.7.2024, Criminal Bail Application No.217 of 2024 dated 14.6.2024. By the said orders, the Sessions Court has released the co-accused Anmolsingh Tak, Mohansingh Tak, Balusingh @ Deepaksing Dilipsing Tak, Geetakaur K. Bhada and Mrs. Barsatkaur M. Bhada. The learned counsel for the applicant submits similar role is attributed to the applicant. 6.

On the other hand, the learned APP for the respondent/State submits that there is recovery of gold ornaments at the instance of the present applicant. It is further submitted that the applicant is involved in one more crime of similar nature. It is submitted that considering the said facts, the applicant may not be released on bail.

I have perused the charge-sheet. The role attributed to coaccused Anmolsingh Tak and Mohansingh Tak appears to be more serious than the present applicant. As the Sessions Court has granted bail to them and thus I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Bail Application is allowed.

B] The applicant be released on bail in C.R. No.131 of 2024 registered at Barshi City Police Station, Dist. Solapur for the offences punishable under Sections 457, 380 read with 34 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C] The applicant shall attend the concerned police station once in a month ,i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial.
