This is an application for regular bail.

The applicant is accused in Sessions Case No.89 of 2019 for the offences punishable under Sections 302, 307, 326, 392, 394 read with section 34 of the Indian Penal Code(IPC). 3.

By order dated 8th April 2019, the applicant was released on bail on certain conditions and one of the conditions was that the applicant will not commit any other crime. On 04.09.2020, the Investigating Officer submitted a report to the Trial Court that the applicant after his release on bail committed four crimes. The Trial Court has, thus, by order dated 04.09.2020 cancelled the bail of the applicant. The Trial Zeenat Pathan

909-BA-4560-2024.doc Court thereafter by order dated 08.09.2023 has rejected the bail application filed by the applicant.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

It appears that the applicant after cancellation of bail, is in jail for about three years and there is absolutely no progress in the trial as the trial is still at the stage of framing of charges. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in Sessions Case No.89 of 2019 for the offences punishable under Sections 302, 307, 326, 392, 394 read with section 34 of the Indian Penal Code(for short 'IPC') on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;

(iii) The applicant shall not commit any other crime; (iv) The applicant shall attend the concerned Police Station once in a month i.e. on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (v) Application stands disposed of accordingly.
