By the present Application filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS"), the Applicant is seeking regular bail in Crime No. 187 of 2024 registered at Laxmipuri Police Station, Kolhapur for offence punishable under Section 302, 120-B, 108, 109, read with Section 34 of the Indian Penal Code. Said Crime is now registered as Sessions Case No. 178 of 2024 and is pending on the file of the learned Additional Sessions Judge, Kolhapur.

There are 8 Accused in the present crime. Applicant is Accused No. 4.

Ms. Parulekar, learned Advocate for the Applicant submits that Shrikrishna Arjun Mane (Accused No. 5) in the said crime was granted pre-arrest bail by this Court by order dated 10th July, 2024 passed in Criminal Anticipatory Bail Application No. 1741 of 2024 (page 463). She submits that Hrunal @ Balaji Pratap Disale (Accused No. 7) in the present crime is released on bail by the learned Additional Sessions Judge, Kolhapur by order dated 1st August, 2024 passed on Bail Application at Exh. 1 in Criminal Bail Application No. 750 of 2024. She tenders copy of the order dated 1st August, 2024, which is taken on record and marked "X" for identification. She submits that involvement of the Accused Nos. 5 and 7 in the said crime is similar and identical to the involvement as alleged in respect of the Applicant. She submits that Accused Nos. 5 and 7 being released on bail, on similar and identical situation in the said crime, the Applicant herein would be entitled to bail on the ground of parity. She submits that the Applicant has no criminal antecedents.

Ms. Veera Shinde, learned APP submits that subject crime is a serious crime. She however, submits that the involvement of the Accused Nos. 5 and 7 in the said crime is identical to the involvement of the Applicant herein. She submits that the case of the Applicant can be considered on the ground of parity.

I have perused the records with the assistance of the learned Advocates.

Perusal of the charge-sheet in the present crime reveals that the role assigned to the Applicant (Accused No. 4) and the role assigned to the Accused Nos. 5 and 7 are identical. This Court as well as learned Additional Sessions Judge, Kolhapur on the said facts have released the Accused Nos. 5 and 7 on bail. Applicant being similarly placed like the Accused Nos. 5 and 7 is entitled to bail on the principle of parity.

In view of the above, the Applicant is entitled to bail on the following conditions :
(a) Applicant be released on bail in Crime No. 187 of 2024 registered with Laxmipuri Police Station upon furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount to the satisfaction of the Additional Sessions Judge, Kolhapur. (b) Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. Applicant shall not tamper with evidence. (c) Applicant upon release, within 3 days shall furnish his residential addresses with proof and contact
details to the Trial Court and Investigating Officer, Laxmipuri Police Station, Kolhapur.
(d) Applicant shall attend each and every date of hearing before the learned Additional Sessions Judge, Kolhapur in Sessions Case No. 178 of 2024, unless exempted.
