These are Applications under Section 439 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking Bail in connection with C.R. No.86 of 2023 registered for offences punishable under Section 8(c) read with Sections 20(a), 20(c) and 29 of the Narcotics and Psychotropic Substances Act, 1985 (for short 'NDPS

Ms. Palanpurwala has argued that Applicants in both aforesaid Applications are incarcerated for 16 months for been in possession of intermediate quantity of alleged contraband namely charas.

She would submit that considering long incarceration of Applicants and rigors of Section 37 of NDPS Act not been applicable, this Court be pleased to consider the submission of Applicants. 6.

Mr. Haldankar, learned APP shall apprise the Court on the next adjourned date after taking instructions. 7.
