This is an Application under Section 439 of the Code of Criminal Procedure, 1973 seeking Regular Bail in connection with C.R.No.41 of 2024 registered with Kalachowki Police Station for the offences punishable under Sections 323 and 307 of the Indian Penal Code, 1860. Applicant is incarcerated for the last one year. 4.

Mr. Satale would draw my attention to the FIR appended at page No.27 of the Application. He would submit that the incident occurred in an open public place where the Applicant alongwith his friend and Accused alongwith his friend were separately seated and

67.BA.4618.24.doc were drinking. He has taken me through the prosecution case which is delineated. He would submit that offence was not committed in a premeditated manner neither there was any intention of the Applicant to commit the offence. He would submit that due to intervention and interjection of both the groups which was desisted by either of the parties their initial verbal altercation escalated to a fight in an inebriated state and the Applicant in a fit of rage on the spur of moment inflicted knife injuries on the victim. He would fairly submit that some of the injuries are grievous in nature. However, he would persuade the Court to consider the occurrence and happening of the said incident on the spur of moment and consider the present Bail Application.

Ms. Yadav, learned APP on behalf of Prosecution is directed to take appropriate cognizance of the submissions made by Mr. Satale and accordingly apprise the Court on the next adjourned date when this Application shall be heard by the Court. 6.
