This is an Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'B.N.S.S.') seeking Bail in connection with C.R. No.305 of 2024 registered with Malad Police Station for offences punishable under Sections 406, 420, 465, 467, 468, 471 and 34 of the Indian Penal Code, 1860 (for short 'IPC'). 4.
Applicant before me is an unmarried woman of 23 years old. Applicant has been indicted under Section 420 and other provisions of IPC. According to the Mr. Manikhedkar she has received an amount of Rs.95,000/- in her bank account which is only case for indictment made against her. He would submit that extent of the crime in
49.BA.4624.2024.doc question is to the tune of approximately Rs.44,73,000/- but it is attributable to the role of other Accused in question who have received the said amounts. He would submit that prima facie he will be able to demonstrate indictment of Applicant with respect to the amount received in her bank account and nothing more even as per prosecution case. Applicant is required to provide care and support to her mother who would be undergoing cataract surgery. 5.
Learned APP shall take appropriate instructions with respect to role of the present Applicant qua crime in question. 6.
