Heard Mr. Chetan Akai alongwith Ms. Swara Vichare, learned Advocates for the Applicant and Mr. Pandurang Gaikwad, learned A.P.P. for the State/Respondent.

The Applicant is charged under Section 376(3) of the Indian Penal Code, 1860 and Sections 4, 6, 8 and 12 of the Protection of Children from the Sexual Offences Act, 2012.

The records placed before me indicate that the Criminal Bail Application No. 419 of 2021 filed by the Applicant was withdrawn. This Court had passed the following order on 1st October 2021 :- "1.

After arguing for some time, when the Court was not inclined to enlarge the Applicant on bail, learned counsel for the Applicant sought leave to withdraw this Gitalaxmi

Accordingly, the Application is dismissed as withdrawn."

Mr. Chetan Akai, learned Advocate for the Applicant fairly states that there are no change in circumstance. He states that the present Application is filed purely on humanitarian ground. 5.

Mr. Pandurang Gaikwad, learned A.P.P. opposes the said Criminal Bail Application by submitting that the offence is a serious offence.

Mr. Chetan Akai, learned Advocate states that the matter before the learned Additional Sessions Judge, Malegaon, i.e., Sessions Case No. 122 of 2020 is now fixed for judgment. 7.

Considering the abovesaid facts, no case is made out to entertain the present Application. Hence, Criminal Bail Application No. 4645 of 2024 is dismissed.
