Heard Ms. Chavan, learned Advocate for Applicant and Ms. Newton, learned APP for State.

Ms. Chavan would submit that indictment of Applicant is on the basis of confession statement of the co-accused who is the principal conspirator. Applicant has been indicted on the allegation that he had induced co-accused into commission of crime. Crime is registered under Section 420 of IPC and total amount involved is Rs. 7 Lakhs (approx.).

Ms. Chavan would submit that bank account of the Applicant has been frozen and there is adequate amount in that bank account which is in excess of Rs. 60 Lakhs which can secure the interest of

61. BA-4684-2024.docx complainant's amount for which the complaint has been filed. In that view of the matter, she would submit that considering that offence is under Section 420 of IPC Applicant who is incarcerated for the past almost one year be released on bail.

Learned APP is directed to take instructions from the Investigating Officer (IO) and apprise the Court about the same on the next adjourned date.

If the aforesaid facts as stated by the learned Advocate for Applicant are correct, this Application shall be appropriately decided on the next adjourned date.
