This is an application for regular bail.

The applicant came to be arrested in Crime No. 467 of 2023 registered at Vani Police Station, Dist- Nashik for the offences punishable under Sections 364, 302, 120-B, 201 r/w 34 of the Indian Penal Code, 4/25 of the Indian Arms Act, under Section 37(1)(3) r/w 135 of the Maharashtra Police Act.

According to the prosecution on account of previous enmity, the present applicant and other co-accused

abducted the deceased and committed his murder. 4.

I have heard the learned counsel for the applicant and the learned APP for the respondent/State. 5.

The bail is sought on the ground of parity. In support of the said ground, the learned counsel for the applicant has produced on record the copy of orders passed by this Court dated 27.09.2024 in Criminal Bail Application No.2189 of 2024 and 15.10.2024 in Criminal Bail Application No.1874 of 2024. By the said order, this Court has released the co-accused Ashok Nawale and Pandit Shelke on bail.

I have perused the statement and supplementary statement of the eye witnesses Ganesh Gangode and Ramesh Dalvi. They have attributed similar role to the applicant and the co-accused Ashok Nawale and Pandit Shelke.

In that view of the matter, I am inclined to release the applicant on bail. In the result, the following order is passed:

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in Crime No. 467 of 2023 registered at Vani Police Station, Dist- Nashik for the offences punishable under Sections 364, 302, 120-B, 201 r/w 34 of the Indian Penal Code, 4/25 of the Indian Arms Act, under Section 37(1)

(3) r/w 135 of the Maharashtra Police Act, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C] The applicant shall attend the concerned police station twice in a month, i.e., on first & third Saturday between 11:00 am to 2:00 pm, till conclusion of the trial.

Application stands disposed of accordingly.
