By this Application, Applicant is seeking regular bail in Crime No.255 of 2022 registered with Bharati Vidhyapeeth Police Station, Pune, for the offences punishable under Section 302 of the Indian Penal Code, 1860 ('IPC' for short).

It is prosecution's case that, the Applicant is the stepfather of the deceased girl, aged 3 years. On 15th April 2022, the Applicant
allegedly slapped the deceased and banged her head against the wall, due to said assault she died while undergoing treatment. 3.
It is contention of learned counsel for the Applicant that, the Applicant is behind bar for almost four years. There is no progress in trial. The Applicant had taken the victim to the hospital. The incident happened on account of sudden provocation, and requested to allow the Application.

It is contention of learned APP that, the Applicant brutally murdered his stepdaughter, aged three years. The charge is framed. The Trial is in progress. If Applicant released on bail, he may abscond or threaten the prosecution witnesses, and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The Applicant is behind bar for more than four years. There is no progress in trial. He has no antecedents. It may take time to conclude the trial.

Considering these facts, I pass following order.
ORDER
(i) The Applicant-Jitendra Uttam Patil be released on bail in Crime No.252 of 2022 registered with Bharati Vidyapeeth Police, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
