This is an application for regular bail.

The applicant came to be arrested in Crime No.72 of 2024 registered at Mhasrul Police Station, Nashik for the offences punishable under Sections 306, 498-A, 323 and 506 of the Indian Penal Code.

The deceased was the wife of the present applicant. It is alleged that the applicant was addicted to liquor. He used to abuse and beat the deceased and used to say that she should not stay with him as he wants to perform second marriage. It is alleged that on 04.04.2024, the deceased, fed up with the said harassment committed suicide.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

Learned counsel for the applicant submits that applicant and Dinesh S. Sherla 1/2
36-BA-4781-24.doc the deceased were married for 15 years. It is submitted that false allegations are made against the applicant. It is submitted that applicant is in jail for 10 months and the trial is not likely to be concluded in near future as it is still at the stage of framing of charge. It is submitted that thus the applicant may be released on bail.

On the other hand, learned APP for the respondent/State submits that considering the nature of offence, the applicant may not be released on bail.

I have perused the charge-sheet. It appears that the deceased and the applicant were married more than 15 years. The applicant is in jail for more than 10 months and the trial is still at the stage of framing of charge. Considering the overall facts and circumstances, I am inclined to release the applicant on bail. In the result, the following order is passed.
O R D E R
A] The Application is allowed.
B] The applicant be released on bail in C.R. No. 72 of 2024 registered at Mhasrul Police Station, Nashik for the offences punishable under Sections 306, 498-A, 323 and 506 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
