By this Application, Applicant is seeking regular bail in Crime No.246 of 2023 registered with Parvati Police Station, Pune, for the offences punishable under Sections 392 read with Section 34 of the Indian Penal Code, 1860 ('IPC' for short), Sections 3(1)(ii) and 3(4) of the The Maharashtra Control of Organised Crime Act, 1999 ('MCOC' Act). 2.

It is prosecution's case that, the Applicant and co-accused were riding on motorcycle, they snatched the gold chain of the First Informant who was walking on the road.

It is contention of learned counsel for the Applicant that the Applicant is behind bar around two years and six months. Yet charge has not been framed. It may take time to conclude the trial. Hence, requested to allow the Application.

It is contention of learned APP that, the Applicant has 30 antecedents. The gold chain is recovered at the instance of the Applicant. The Applicant is habitual offender. If Applicant is released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the Application.

I have heard both learned counsel. Perused, charge-sheet and documents produced on record.

The Applicant is behind bar around more than two years and six months. Yet, charge has not been framed. The co-accused has been released on bail.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Akash Dnyaneshwar Suryawanshi, be released on bail in Crime No.246 of 2023 registered with Parvati Police Station, Pune, on furnishing PR bond of

Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall give attendance before the Investigating Officer once in month on first Monday of every month between 11.00 a.m. to 1.00 p.m., till framing of the charge.
