This is an application for regular bail.

The applicant came to be arrested in Crime No. 52 of 2023 registered at Mahatma Gandhi Chowk Miraj Police Station, District : Sangli for the offences punishable under Sections 307, 452, 324, 143, 147, 148 & 149 Indian Penal Code and Sections 4 & 25 of the Arms Act.

According to the prosecution on account of previous dispute on the date of incident which took place on 04.03.2023, the present applicant and other co-accused assaulted the complainant's brother by Koyata, Sword etc. and attempted to commit his murder.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant submits that the applicant is in jail for two years and the trial has not commenced. It is submitted that the applicant is ready to stay away from Miraj Taluka till conclusion of trial. 6.
On the other hand, the learned A.P.P. for the Respondent-State submits that the present applicant has assaulted the injured by sword. It is submitted that, there are other criminal antecedents against the present applicant. The learned APP submits that considering the nature of offence, the applicant may not be released on bail.

As on today it appears that only one crime is pending against the applicant. The applicant is in jail for two years and the trial has not commenced. Considering the overall facts and circumstances, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No. 52 of 2023 registered at
Mahatma Gandhi Chowk Miraj Police Station, District : Sangli for the offences punishable under Sections 307, 452, 324, 143, 147, 148 & 149 Indian Penal Code and Sections 4 & 25 of the Arms Act on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall not enter into the limits of Miraj Taluka till conclusion of trial except to attend the dates before the trial Court.
(iv) The applicant shall not commit any other crime. (v) Application stands disposed of accordingly.
