Heard Mr. Joshi, learned Counsel appearing for the Applicant, Ms. Pawar, learned Counsel appearing for the Respondent No.2 and Ms. Bhosale, learned APP for the Respondent-State. 2.

This is second bail Application seeking bail in C.R. No.476/2022 registered with Pimpri Police Station, District-Pune, for the offences punishable under Sections 307, 120-B of the Indian Penal Code, 1860 ("IPC") Section 37(1)(3) r/w Section 135 of the Maharashtra Police Act, 1951.

It is the contention of Mr. Joshi, learned Counsel that there is a long incarceration and there is no progress in the trial. He also relies on judgment of Supreme Court in the case of Siddhant @ Sidharth Balu Vaibhav Page No. 1

2-BA-4947-2024.doc Taktode v. The State of Maharashtra & Anr.1 and more particularly on paragraph nos. 15 and 16 of the same. He points out roznama and submits that the Applicant i.e. Accused No.1 has not been produced before the Trial Court physically or virtually. He states that the charge is also not framed.

On the other hand, Ms. Bhosale, learned APP and Ms. Pawar, learned Counsel appearing for the Respondent No.2 states that, there are 19 antecedents against the Applicant. Ms. Pawar, learned Counsel states that there are 2 eye witnesses including the victim for whom she is appearing and there is danger to their life, if, Applicant is released on bail. Ms. Pawar, learned Counsel relies on the affidavit dated 17th June, 2025.

In view of the contentions raised by Mr. Joshi, learned Counsel for the Applicant, Ms. Bhosale, learned APP, seeks time to file affidavitin-reply. Let such affidavit-in-reply be filed on or before 2nd August, 2025.
