This is an application for regular bail.

The applicants came to be arrested in Crime No.383 of 2015 registered at Shikrapur Police Station, Dist. Pune for the offences punishable under Sections 302, 394, 397 r/w Section 34 of the Indian Penal Code and Sections 3(1)(ii), 3(4) of the Maharashtra Control of Organized Crime Act, 1999.

9-BA-5012-2024.doc submits that the applicants are in jail for nine years. It is submitted that even gang leader has been released on bail. 4.

The learned APP has not disputed the fact that the applicants are in jail for nine years. In that view of the matter, I am inclined to release the applicants on bail.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicants are directed to be released on bail in connection with Crime No.383 of 2015 registered at Shikrapur Police Station, Dist. Pune for the offences punishable under Sections 302, 394, 397 r/w Section 34 of the Indian Penal Code and Sections 3(1)(ii), 3(4) of the Maharashtra Control of Organized Crime Act, 1999 on executing P.R. Bond in the sum of Rs.25,000/- each with one or two sureties in the like amount;

(iii) The applicants shall attend the concerned Police Station once in a month on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial;

(iv) The applicants shall not commit any crime in future.

(v) It would be open to the prosecution to file an application for cancellation of bail, if the applicants commit breach of aforesaid conditions.
