In the present case, Applicant is incarcerated for more than 3 and 1⁄2 years in an offence under the provisions of Indian Penal Code, 1860 and Protection of Children from Sexual Offences Act, 2012 for having set on fire the house of his mother-in-law. 4.

Prima facie considering the long standing dispute and enmity between the Applicant and First Informant - wife which is borne out from the record and the long incarceration of the Applicant in the facts and circumstances of the present case, Application shall be heard and decided on the next adjourned date which shall be noted by the prosecution.
