Heard Mr. Sharma, learned Advocate for Applicant and Mr. Karmakar, learned APP for State.

Applicant has been incarcerated from 29.05.2022 i.e. for the last 2 years and 7 months. He is arraigned as accused No. 4. Accused No. 1 has been arrested from a railway station (public place) while in possession of counterfeit currency. Appropriate crime has been lodged. He has revealed the name of accused No. 2. On apprehension of accused No. 2, he has revealed name of accused No. 3 and on apprehension of accused No. 3, he has revealed the name of accused No. 4 i.e. the present Applicant before me.

Mr. Sharma would draw my attention to the chargesheet which is appended to the Application and would submit that in the entire chargesheet, the reason as to why accused No. 3 revealed the name of

27. BA-5099-2024.docx accused No. 4 is not stated. He would submit that merely phone number of accused No. 4 has been shared by accused No. 3. He would submit that Applicant before me is leading a life of renunciation for the last 12 years and is leading the life of a monk in an Ashram. He would submit that Applicant does not know accused No. 3 and has no nexus whatsoever with him.

Mr. Karmakar, learned APP appears for Respondent. Copy of the Application shall be served immediately on the learned APP. In fact it is given to the prosecution in my presence. Learned APP shall take appropriate instructions and inform the Court accordingly on the next adjourned date so that appropriate orders can be passed in the present Application.
