Mr. Ayaz Khan, learned counsel appearing for the Applicant, on instructions, seeks permission to withdraw the present Bail Application with liberty to file a fresh Bail Application after a period of 3 months, if the trial does not progress substantially. Permission to withdraw with the liberty is granted.

Mr. Khan, learned counsel appearing for the Applicant, has placed on record the roznama maintained by the Trial Court. It is seen from the roznama that the charges were framed on 28th November 2024. However, till date, the prosecution has continued to examine the 1st witness (P.W.1) for a period of almost 1 year. Advocate for the ApplicantAccused is also seen to be absent. 3.
Be that as it may, the prosecution is requested to conclude the trial within a period of 3 months from the date on which this order is presented before it.

Ms Anuja Gotad, learned APP representing the State in the matter, is also directed to ensure through the Prosecutor appearing in the Trial Court that the prosecution witnesses remain present in the Court for recording of their evidence. 5.
It is further directed that the prosecution shall not seek any adjournments in future, for any unjustifiable reasons.

Needless to state that I have not heard the matter on merits and as such, keep all contentions of all the parties on merits, open.
