This is an application for regular bail.

The applicant came to be arrested in Crime No. 123 of 2024 registered at Adgaon Police Station, Dist- Nashik for the offences punishable under Sections 376(2)(n), 377, 354(D) and 506 of the Indian Penal Code.

The applicant and the victim were working together in Sonalika Tractor Showroom. It is alleged that one day he called the victim to his house and committed forcible sexual intercourse with her. It is alleged that he repeatedly committed forcible sexual intercourse with the victim by threatening her.

I have heard the learned counsel for the applicant, the learned APP for the respondent/State and perused the statement of the victim.

It appears that the applicant and the victim were in live-in-relationship. They stayed together for more than six months. Prima-facie the alleged act, therefore, appears to be consensual. In that view of the matter, I am inclined to release the applicant on bail. In the result, the following order is passed:
O R D E R
A] The Application is allowed.
B] The applicant be released on bail in Crime No. 123 of 2024 registered at Adgaon Police Station, Dist- Nashik for the offences punishable under Sections 376(2)(n), 377, 354(D) and 506 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
C] The applicant shall attend the concerned police station once in a month, i.e., on first Saturday between 11:00 am to 2:00 pm, till conclusion of the trial.
D] The applicant shall not contact the victim.

Application stands disposed of accordingly.
