This is an application for regular bail.

The applicant came to be arrested in Crime No.59 of 2021 registered at Gaganbawada Police Station, District : Kolhapur for the offences punishable under Sections 307, 324, 504, 506 of the Indian Penal Code(for short 'IPC'). 3.
It is alleged that on the date of incident which took place on 22.09.2021, the present applicant assaulted his wife by sharp weapon (Khurpa) and attempted to murder her, due to certain matrimonial disputes.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant submits that the applicant is in jail for three years and six months and except framing of charge there is no progress in the trial. 6.
On the other hand, the learned A.P.P. for the Respondent-State submits that the applicant has assaulted the injured by deadly weapon. It is submitted that considering the nature of offence, the applicant may not be released on bail. 7.
The fact that the applicant is in jail for three years and six months is not disputed. There are no other criminal antecedents against the applicant. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No.59 of 2021 registered at Gaganbawada Police Station, District : Kolhapur for the offences punishable under Sections 307, 324, 504, 506 of the Indian Penal Code(for short 'IPC') on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall not enter into the jurisdiction of Gaganbawada Police Station.
(iv) Application stands disposed of accordingly.
