This is an application for regular bail.

The applicant came to be arrested in Crime No.368 of 2023 registered at Parvati Police Station, District : Pune, for the offences punishable under Sections 302 and 201 of the Indian Penal Code, 1860 (for short 'IPC').

According to the prosecution, the deceased and the applicant were in relationship. It is alleged that on the date of incident, which took place on 12.08.2020 quarrel took place between the deceased and the applicant as the applicant was having affair with the another woman. It is alleged that during
the said quarrel, the deceased slapped the applicant. It is alleged that the applicant got annoyed and assaulted the deceased by stone and committed her murder.

The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that after three years of the incident, the present crime came to be registered.

On the other hand, the learned A.P.P. submits that there is enough material to connect the applicant with the alleged crime. It is submitted that considering the nature of crime, the applicant may not be released on bail. 6.
I have perused the First Information Report (FIR). The reason for registering the crime appears to be cause of death mentioned in the post-mortem report. However, it is not clear as to why the crime was not registered immediately after receipt of post-mortem report. Even otherwise the case is based on circumstantial evidence. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No.368 of 2023 registered at Parvati Police Station, District : Pune, for the offences punishable under Sections 302 and 201 of the Indian Penal Code, 1860 (for short 'IPC'), on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall attend the concerned Police Station once in a month i.e. on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) Application stands disposed of accordingly.
