This is an application for regular bail.

The applicant came to be arrested in Crime No. 25 of 2024 registered at Dapoli Police Station, District : Ratnagiri for the offences punishable under Sections 307, 324 and 354 of the Indian Penal Code.

According to the prosecution, on the date of incident which took place on 23.02.2024, the present applicant assaulted the victim and attempted to commit her murder as she resisted his act of dragging her to some isolated place with Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:
2025.04.03 14:15:51 +0530 intent to commit rape on her.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant submits that the the victim has sustained only simple injuries and therefore possibility of false implication can not be ruled out. It is submitted that the applicant is in jail for one year and there are no other criminal antecedents against him. 6.
On the other hand the learned A.P.P. for the Respondent State submits that considering the nature of crime, the applicant may not be released on bail. 7.
I have perused the injury certificate. The injuries are simple in nature. In that view of the matter, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No. 25 of 2024 registered at Dapoli Police Station, District : Ratnagiri for the offences punishable under Sections 307, 324 and 354 of the Indian Penal Code, on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall attend the concerned Police Station once in a month i.e. on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) The applicant shall not enter into the Village Revali (Marathwadi), Taluka Dapoli, till conclusion of trial. (v) Application stands disposed of accordingly.
