By this application, the applicant is seeking regular bail in Crime No. 1415 of 2023 registered with Hadapsar Police Station, District Pune, for the offences punishable under Sections 392, 395 and 120-B of the Indian Penal Code 1860 and Section 142 of the Maharashtra Police Act.

It is prosecution's case that on 14th September 2023 around 10:30 PM, the applicant and co-accused snatched the mobile of the first informant by giving a threat to him.

It is contention of learned counsel for the applicant that the SHUBHADA SHANKAR KADAM applicant is behind bars for more than two years and three months. There is no progress in the trial. The co-accused, against whom similar SHUBHADA SHANKAR KADAM Date: 2026.01.19 18:46:54 +0530
allegations are made, is released on bail by the Sessions Court and, therefore, the applicant is entitled to bail on the ground of parity. The mobile of the first informant is recovered from the accused who has been released on bail, hence, requested to allow the application. 4.
It is contention of learned APP that the applicant was externed from Pune District, and while on externment, he has committed this offence. He has two antecedents. If he is released on bail, he may abscond and threaten the prosecution witnesses, and therefore, requested to reject the application.

I have heard both learned counsel, perused the charge sheet and the documents produced on record. The applicant is behind bars for more than two years and three months. The co-accused, against whom similar allegations are made, is released on bail. Considering these facts, the applicant is entitled to bail on the ground of parity. Hence, I pass following order :
ORDER
(i) The applicant be enlarged on bail in Crime No. 1415 of 2023 registered with Hadapsar Police Station, District Pune, on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.
(ii) The applicant shall attend the concerned police station as and when required.
(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.
The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
